General contractual provisions
1. Conclusion of contract

You can book your rental property at www.ferienleukerbad.ch by telephone, verbally, in writing, by e-mail or on the Internet. When your booking arrives, the contract is concluded. From this point on, the rights and obligations under the contract and these terms and conditions will take effect for you and the landlord. You will receive a reservation confirmation from us. The information in the reservation confirmation (namely object, occupancy, duration, price) is binding.

The rental amount is to be paid as follows:

  1. 50% within 10 days of receipt of the reservation confirmation, the balance before the start of the rental period.
  2. For short-term reservations less than 10 days before the start of the rental period, the entire rental price must be paid within five days of receipt of the reservation confirmation.
  3. If the remaining amount or the entire rental price is not paid on time for short-term reservations, the landlord has the right to refuse to hand over the rental property.

If the down payment is not made, the contract is null and void and you owe the landlord the cancellation fee.

2. Cancellations and early return of the rental property

The tenant can withdraw from the contract at any time under the following conditions:

  • CHF 100 processing fee
  • 41 to 25 days before arrival: 50% of the rental price
  • 24 to 15 days before arrival, no-show: 80% of the rental price
  • 14 to 0 days before arrival, no-show: 100% of the rental price

The receipt of the notification by the landlord or the booking office is decisive for the calculation of the cancellation fee (on Saturdays, Sundays and public holidays the next working day applies; the holiday regulation at (residence of the landlord or booking office) is decisive.

The landlord recommends that the tenant take out cancellation insurance, which covers the cost of the rent in the event of accidents, illness or death.

3. Minimum rental period / arrival and departure days

The minimum rental period is seven days in the high season and three days in the rest of the time. The day of arrival and departure are recorded in the reservation confirmation. The rental property must be picked up on the day of arrival at 4 p.m. and returned by 9 a.m. on the day of departure. If the rental property is not taken over or is delayed or left prematurely, the entire rental price remains due.

4. Price / additional costs / price change

The prices published by the landlord are current prices for the entire rental property. The price published on the Internet (www.ferienleukerbad.ch) is decisive. With the booking you accept this price. The price does not include the garage or any additional services such as a cot or additional beds, depending on availability. We reserve the right to change prices compared to the published prices. The information in the reservation confirmation is binding.

5. Careful use

The rental property may be occupied by a maximum of the number of people listed in the contract (including children under 16 years of age). Pets (including dogs, cats, birds, etc.) are not allowed unless this has been expressly agreed with the landlord. The tenant undertakes to use the rental property with care, to adhere to the house rules and to show consideration for the other residents and neighbors. In the event of any damage, etc., the landlord / key holder must be informed immediately. Subletting is not allowed. If tenants, housemates or guests violate the obligations of careful use in a blatant way or if the apartment is occupied by more than the contractually agreed number of people, the landlord / key holder can subsequently charge the additional costs owed.

6. Liability

The landlord guarantees a proper reservation and contractual fulfillment of the contract. In the case of damage other than personal injury, liability is limited to twice the rent, unless there is gross negligence or intent. Liability is excluded for actions and omissions on the part of the tenant (including housemates and guests), unforeseeable or unavoidable omissions by third parties, force majeure or events that the landlord, key holder, broker or other persons called in by the landlord, despite due care, do not foresee or prevent could. The tenant is liable for all damage caused by him or his fellow residents, including guests, the fault is assumed. If damage is found after the rental property has been returned, the tenant is also liable for this, provided that the landlord can prove that the tenant (or his housemates or guests) caused the damage.

7. Choice of law and place of jurisdiction

The relationship between you and the landlord is subject exclusively to Swiss law. The place of the rental property is agreed as the exclusive place of jurisdiction.
